如何撰寫出符合歐盟及亞馬遜要求的DoC符合性聲明文件？ 附贈歐盟DoC模板 ！-ESG跨境

相信不少出口商品到歐盟的亞馬遜賣家收到亞馬遜的郵件，通知賣家要提供商品的??符合性聲明（Declaration of Conformity，下列簡稱“DoC”）。

這段時間與許多賣家進(jìn)行交流，發(fā)現(xiàn)賣家們對于DoC符合性聲明文件存在許多不清楚的地方。作為一個賣家，應(yīng)該如何安全穩(wěn)當(dāng)?shù)膶⑸唐蜂N售到歐盟市場？

首先我們先來普及一下基礎(chǔ)內(nèi)容：

DoC符合性聲明文件是什么意思？

An EU declaration of conformity (DoC) is a mandatory document that you as a manufacturer or your authorised representative need to sign to declare that your products comply with the EU requirements. By signing the DoC you take full responsibility for your product's compliance with the applicable EU law.

根據(jù)歐盟規(guī)定DoC是一個強(qiáng)制性的文件。作為一個制造商或授權(quán)代表，需簽署聲明的您的產(chǎn)品符合歐盟要求。通過簽署DoC文件，表明對產(chǎn)品符合適用的歐盟法律，并負(fù)有全部責(zé)任。

合格的DoC文件需要具備那些條件呢?

As a manufacturer, it is your responsibility to draw up the EU declaration of conformity (DoC). It should contain the following information.

作為制造商，您有責(zé)任草擬歐盟合格聲明（DoC）。它應(yīng)包含以下信息：

1）your name and full business address or that of your authorised representative.

（您的姓名和完整的公司地址或授權(quán)代表的名字）

2）the product's serial number, model or type identification.

（產(chǎn)品的序列號，型號或類型標(biāo)識）

3）a statement, stating you take full responsibility.

聲明，說明您承擔(dān)全部責(zé)任（聲明您承擔(dān)全部責(zé)任）

4）means of identification of product allowing traceability – this can include an image.

可以追溯的產(chǎn)品識別手段-可以包括一張圖片（允許返回的產(chǎn)品標(biāo)識方法-可包括圖片）

5）the details of the notified body which carried out the conformity assessment procedure (if applicable) .

進(jìn)行合格評定程序的指定機(jī)構(gòu)的詳細(xì)信息（如適用）

6）the relevant legislation with which the product complies, as well as any harmonised standards or other means used to prove compliance.

（產(chǎn)品遵守的相關(guān)法律以及用于證明符合性的任何統(tǒng)一標(biāo)準(zhǔn)或其他方式）

7）your name and signature.

（您的姓名和簽名）

8）the date the declaration was issued.

（聲明簽發(fā)日期）

9）supplementary information (if applicable).

（補充信息（如果適用））

10）For imported products, the importer must ensure that the product is accompanied by the DoC and must keep a copy of it for 10 years after the product has been placed on the market.

（對于進(jìn)口產(chǎn)品，進(jìn)口商必須確保該產(chǎn)品隨附DoC，并且必須在產(chǎn)品投放市場后將其副本保存10年。）

11）You must translate the EU declaration of conformity into the language or languages required by the EU country in which your product is sold.

（對于進(jìn)口產(chǎn)品，進(jìn)口商必須確保該產(chǎn)品隨附DoC，并且必須在產(chǎn)品投放市場后將其副本保存10年。您必須將歐盟符合性聲明翻譯成產(chǎn)品銷售所在國家/地區(qū)所要求的一種或多種語言。）

根據(jù)歐盟的條款，目前是制造商具有起草歐盟符合性聲明文件的權(quán)益，這邊所謂的制造商，可以泛指為產(chǎn)品的生產(chǎn)商或是品牌方，也就是產(chǎn)品或是品牌的擁有者，方可起草歐盟符合性聲明文件。

歐盟條款條款如下：

Manufacturers play a crucial role in ensuring that products placed on the extended single market of the European Economic Area (EEA) are safe. They are responsible for checking that their products meet EU safety, health, and environmental protection requirements. It is the manufacturer’s responsibility to carry out the conformity assessment, set up the technical file, issue the EU declaration of conformity, and affix the CE marking to a product. Only then can this product be traded on the EEA market.

制造商在確保投放到歐洲經(jīng)濟(jì)區(qū)（EEA）擴(kuò)展單一市場上的產(chǎn)品的安全性方面起著至關(guān)重要的作用。他們負(fù)責(zé)檢查其產(chǎn)品是否符合歐盟的安全，健康和環(huán)保要求。制造商有責(zé)任進(jìn)行合格評定，建立技術(shù)文件，發(fā)布?xì)W盟合格聲明并在產(chǎn)品上粘貼CE標(biāo)志。只有這樣，該產(chǎn)品才能在EEA市場上交易。

If you are a manufacturer, you have to follow these 6 steps to affix a CE marking to your product:

如果您是制造商，則必須按照以下6個步驟在產(chǎn)品上粘貼CE標(biāo)志：

1）Identify the applicable directive(s) andharmonised standards.

（確定適用的指令和協(xié)調(diào)的標(biāo)準(zhǔn)）

2）Verify product specific requirements.

（驗證產(chǎn)品特定要求）

3）Identify whether an independentconformity assessment(by a notified body) is necessary.

(確定是否需要（由指定機(jī)構(gòu)進(jìn)行的）獨立合格評定)

4）Test the product and check its conformity.

（測試產(chǎn)品并檢查其合格性）

5）Draw up and keep available the required technical documentation.

（草擬并保留所需的技術(shù)文檔）

6）Affix theCE markingand draw up theEU Declaration of Conformity(27 KB).

（貼上CE標(biāo)記并起草EU合格聲明）

These 6 steps may differ by product as the conformity assessment procedure varies. Manufacturers must not affix CE marking to products that don’t fall under the scope of one of the directives providing for its affixing.

（隨著合格評定程序的變化，這6個步驟可能因產(chǎn)品而異。制造商不得將CE標(biāo)記粘貼到不屬于其粘貼說明之一的產(chǎn)品范圍內(nèi)。）

DoC文件應(yīng)該由誰來簽署負(fù)責(zé) ?

根據(jù)歐盟產(chǎn)品合規(guī)法規(guī)顯示，＂制造商＂是具有起草DoC符合性聲明權(quán)利的人，而所謂的“制造商”泛指為產(chǎn)品的生產(chǎn)商或是品牌方。

歐代需要在DoC文件上簽字嗎？

根據(jù)歐盟的相關(guān)政策指導(dǎo)文件表示，歐代不需要在DoC符合性聲明文件簽字。

DoC符合性聲明文件的意義，在于表達(dá)產(chǎn)品的生產(chǎn)商或是品牌方，對自己的產(chǎn)品符合歐盟合規(guī)條款是負(fù)全責(zé)的，屬于自我聲明的文件。即便歐代對于制造商交付的產(chǎn)品需要付連帶責(zé)任，但畢竟他不是產(chǎn)品或是品牌的擁有者。

在歐盟委員會發(fā)布的DoC模板中有提及：

This declaration of conformity is issued under the sole responsibility of the manufacturer.

（此符合性聲明由制造商全權(quán)負(fù)責(zé)。）

綜合上述，DoC符合性聲明表面上是一個非常簡單好處理的聲明文件。但是其在歐盟國家的意義，跟CE認(rèn)證一樣重要，決定著該商品是否能夠在市場上銷售。在歐盟產(chǎn)品合規(guī)法案正式落地之前，亞馬遜平臺也在持續(xù)打擊不合規(guī)的CE標(biāo)志產(chǎn)品，因此，賣家還是需要重視起來。
